FCC Proposes AI Disclosure Rules for Political Ads

The Federal Communications Commission (FCC), led by Chairwoman Jessica Rosenworcel, is initiating a rulemaking process to potentially mandate that political advertisements on broadcast TV and radio include disclaimers about artificial intelligence (AI) usage. This proposal, announced on Wednesday, aims to address concerns over AI-generated deepfakes that may disrupt elections. The new rules would require on-air disclosures and written notices for political advertisements containing AI-generated content. The FCC’s jurisdiction, however, does not extend to internet-based media such as streaming services or social media.

Arizona Passes AI Deepfake Law

In Arizona, Republican State Representative Alexander Kolodin used AI chatbot ChatGPT to help draft part of a new law regulating deepfakes in elections. The bill, which passed unanimously and was signed by the governor, provides mechanisms for candidates to challenge the authenticity of suspected deepfakes in court. Unlike many states, Arizona’s approach does not outright ban deepfakes but allows for court interventions and potential removal of misleading content, especially if it involves private individuals depicted in vulnerable situations.

Broader Legislative Efforts

At the federal level, bipartisan efforts are underway to regulate AI in political advertising. Senators Amy Klobuchar and Lisa Murkowski have introduced the AI Transparency in Elections Act, proposing disclaimers on AI-generated political ads. Senate Majority Leader Chuck Schumer also emphasizes the need for legislative guardrails, although passing meaningful AI legislation during an election year remains challenging.
